General Terms Of Use For The "LOGIONE" Software

1.Scope 
The use of the software ("App") offered by Fritz Schäfer GmbH, Fritz-Schäfer-Straße 20, 57290 Neunkirchen/Sieger-land, Germany ("SSI") is subject to these Terms of Use.

2.Rights of use
The App is protected by copyright. From entry into force of the contract, SSI grants the Customer a non-exclusive, non-transferable, and non-sublicensable right to use the Software.
The Software may contain third party components, including open source software. Parts of these third party components are subject to license terms that differ from these terms. Information about third party components can be found in the installation folder in the license directory “licence” and can also be viewed prior to download. SSI reserves the right to introduce deviating or additional license conditions of third parties in connection with changes to the services, in particular in the context of updates for software, as far as this is necessary due to additional third party components or changed license conditions of third parties.

3. Warranty and liability
As far as the App is provided free of charge, there are no warranty rights in accordance with the legal regulations, and SSI is only liable in cases of intent or gross negligence, especially in cases of fraudulent concealment of a defect in the App.

4.Final provisions
SSI reserves the right to discontinue the infrastructure behind the App.
These Terms of Use are exclusively governed by the laws of the Federal Republic of Germany, excluding the conflict of laws rules. The place of jurisdiction is the competent court in Siegen (Germany).
If any provision of the Agreement or these Terms of Use is invalid, this shall not affect the validity of the remaining provisions. The contracting parties shall cooperate to replace invalid provisions with provisions that correspond as closely as possible to the invalid provisions. The above provision shall apply mutatis mutandis in the event of loopholes.
These provisions apply exclusively to the LOGIONE software and not to the distribution of other software, the LOGIMAT or other products and services of SSI.
